Please read these Terms of Service ("Terms") carefully before using the OndaHear mobile application ("App") operated by OndaHear ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using OndaHear, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

OndaHear is a hearing assistance application that provides:

• Audio amplification through your device
• Live speech-to-text captions
• Speech translation (iOS 26+)
• Device-to-device audio transmission

3. Medical Disclaimer

OndaHear is not a medical device. The App is intended for personal sound amplification and accessibility assistance only. It is not designed to diagnose, treat, cure, or prevent any medical condition, including hearing loss.

If you have concerns about your hearing, please consult a qualified healthcare professional or audiologist. OndaHear should not be used as a substitute for professional medical advice, diagnosis, or treatment.

4. Eligibility

You must be at least 13 years old to use OndaHear. If you are under 18, you must have permission from a parent or legal guardian.

5. Account and Subscription

5.1 Free Tier

OndaHear offers a free tier with limited daily usage. Free users have access to basic features with time restrictions.

5.2 Premium Subscription

Premium subscriptions are available on a weekly ($2.99/week), monthly ($9.99/month), or annual ($89.99/year) basis. Subscriptions provide unlimited access to all features.

5.3 Payment and Renewal

Subscriptions are billed through your Apple ID account. Payment will be charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

5.4 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial periods.

6. Intended Use

OndaHear is designed exclusively for personal hearing assistance, including amplifying environmental sounds, providing live speech-to-text captions, translating speech, and facilitating communication for individuals with hearing difficulties. The App must only be used for these intended purposes.

7. Anti-Surveillance & Lawful Use

You must not use OndaHear to secretly record, monitor, or eavesdrop on any person's private conversations or activities.

Many jurisdictions require the consent of all parties before a conversation may be recorded or monitored. Violations may constitute criminal offenses under federal, state, or international wiretapping, eavesdropping, and privacy laws, including but not limited to:

• The U.S. Federal Wiretap Act (18 U.S.C. § 2511)
• State two-party consent laws (e.g., California, Florida, Illinois)
• The EU General Data Protection Regulation (GDPR)
• Equivalent laws in your jurisdiction

You are solely responsible for ensuring your use of OndaHear complies with all applicable laws. The developer assumes no liability for any illegal use of the App.

8. Acceptable Use

You agree not to use OndaHear to:

• Record, transcribe, or monitor conversations without the knowledge and consent of all parties
• Conduct surveillance or covert monitoring of any person
• Violate any applicable wiretapping, eavesdropping, or privacy laws
• Infringe on the rights or privacy of others
• Engage in any illegal or unauthorized activities
• Use in safety-critical situations where accurate hearing is essential
• Attempt to reverse engineer, decompile, or disassemble the App

9. Intellectual Property

OndaHear and its original content, features, and functionality are owned by OndaHear and are protected by international copyright, trademark, and other intellectual property laws.

10. User Content

Any transcripts or recordings you create using OndaHear remain your property. We do not claim ownership of your content. You are responsible for ensuring you have the legal right to create and store such content, including obtaining any required consent from other parties.

11. Privacy

Your use of OndaHear is also governed by our Privacy Policy. OndaHear processes all audio locally on your device and does not transmit your data to external servers.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will function uninterrupted or error-free
• Defects will be corrected
• Captions or translations will be accurate or complete
• The App is suitable for safety-critical situations
• The results of using the App will meet your requirements

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONDAHEAR AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Hearing damage from improper volume settings
• Missed or inaccurate audio, captions, or translations
• Legal consequences arising from misuse of the App (including unlawful recording or surveillance)
• Loss of profits, data, use, or goodwill

You assume all risk associated with your use of the App and agree to indemnify and hold harmless OndaHear and its developer from any claims arising from your use or misuse of the App.
